Ana Pastor, Minister of Fomento (Ministry of development in Spain) has published new laws for long-term rentals.&amp;nbsp;Non-paying tenants are required to provide a valid excuse for non-payment of rent. If a valid argument is not provided and payment is still not made within 10 days, the court will rule the immediate eviction of the non-paying tenant.&amp;nbsp;&lt;/p&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&amp;nbsp;This is a slight amendment to what was announced back in October regarding the&lt;strong&gt; &lt;a title="New laws passed to speed up eviction process in Spain" href="http://www.spanishvilla.com/_blog/Spanish_Property_News/post/New_law_passed_to_speed_up_evictions_of_rented_property_in_Spain/"&gt;non payment of rental&lt;/a&gt; &lt;/strong&gt;and was not entirely clear as to when the courts would announce an eviction date. Now it appears to be much clearer. "Immediate court eviction", being the most important factor. &lt;br /&gt;
&lt;br /&gt;
If any of our readers has to evict a tenant since the passing of this new law please tell us how you have got on with the whole process. It would be great to know that the amendments made in the eviction process on paper are actually reflected in reality too. It is a no brainer though, less paperwork and court hours for the judges and less headaches for the landlords....&amp;nbsp;&lt;br /&gt;
&lt;br /&gt;
Other changes were also made with regards to the duration of long-term rental agreements. Before, a standard rental agreement was required, offering a 12 month long term tenancy that could be forcefully renewed by a tenant for the maximum period of 5 years.&amp;nbsp;
&lt;p class="p1"&gt;
&lt;br /&gt;
The new law now states that the maximum renewal period is for as much as 3 years and in the event that it is absolutely necessary, a landlord can express his/her will to rescind their agreement by simply offering 60 days notice. This can only happen however, when it is for personal or direct family reasons and means that as a result the property that is being rented is needed to provide a home for those family members. &lt;br /&gt;
&lt;br /&gt;
This is not actually a new law that has been passed and has in fact always been the case, however the government has reminded property owners of the measures that can be taken in unforeseeable circumstances.&lt;br /&gt;
&lt;br /&gt;
It is recommended however that if you have a respectful and good long-term tenant in your property, that a suitable and flexible agreement, with a longer notice period, be negotiated when unforeseen circumstances arise.&amp;nbsp;&lt;br /&gt;

&lt;p class="p1"&gt;This new legislation has been passed in an aim to boost the &lt;a title="Long-term rentals Spain" href="http://www.spanishvilla.com/spanish-property-for-rent/rental-homes-index"&gt;&lt;strong&gt;long-term rental market in Spain&lt;/strong&gt;&lt;/a&gt; and hopefully fill the thousands of empty properties that have been purchased for &amp;ldquo;investment purposes&amp;rdquo;.&lt;br /&gt;
&lt;br /&gt;
&lt;/p&gt;
&lt;p class="p1"&gt;The new plan also tips the balance in the favour of landlords so that long-term rentals from hell are hopefully going to be a thing of the past.&amp;nbsp;&lt;br /&gt;
&lt;br /&gt;
Fomento have also announced that they will be working on a new database to register and store the names of bad paying tenants that have been evicted or reported by landlords making it easier for estate agencies to check the track record of all potential long-term rental candidates. I suppose it is will be similar to ASNEF that is currently used to register bad debtors in Spain.&amp;nbsp;&lt;br /&gt;
&lt;br /&gt;
As a final and useful tip it should also be drafted into your long term agreement that in the event of an unforeseen incident, that the tenant has the obligation to communicate it to the landlord immediately and in the meantime payment of the rent should continue unless agreed otherwise between the two parties. &lt;br /&gt;
&lt;br /&gt;
This way if a tenant tries to make excuses and deliberately find problems in the property in order to refuse payment, the landlord can still force the tenant to continue paying the rent whilst a solution is being found in an agreed and respectful timescale. A tenant dies not have the right to cease payment as a result of a problem that has occurred in the property unless the landlord has agreed otherwise.&amp;nbsp;&lt;br /&gt;
&lt;br /&gt;
Communication of the new laws should also be notified to existing tenants that are renting your property by means of a "burofax con acuse de recibo", * Recorded letter with a notification to the sender that the letter has been received.&lt;br /&gt;

As for the property market, Pastor announced the extension, with little change to the previous government's incentive, in relation to&amp;nbsp;&lt;strong&gt;&lt;a href="http://www.spanishvilla.com/properties-for-rent/long-term-villa-rental-in-alenda-golf" title="Spanish property to rent"&gt;long-term rentals&lt;/a&gt;&lt;/strong&gt; and the nationwide refurbishment of "cascos antiguos" (old towns) in order to improve properties that are more than 30 years old. &lt;br /&gt;

It was added that newer measures will also be taken to tackle and reduce the stock problem that Spain currently has, an astonishing reality that has now reached over 700,000 unsold properties. &lt;br /&gt;

The final decision is to &amp;ldquo;eliminate&amp;rdquo; unjustifiable burdens / encumbrances on land and planning.&amp;nbsp;&lt;/p&gt;

&lt;br /&gt;
&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span&gt;Ryanair reduced their flights to &lt;a href="http://www.spanishvilla.com/_blog/Spanish_Property_News/post/Alicante_opens_new_Airport_terminal/" title="New Alicante airport terminal"&gt;Alicante airport&lt;/a&gt;&amp;nbsp;by 50% this winter and in the first trimester of 2012 a further 10%, which has resulted in the loss of up to 200.000 passengers. &lt;br /&gt;
&lt;br /&gt;
&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span&gt;Although some opinions say that Ryanair should be not allowed to &amp;ldquo;Hacer lo que les da la gana&amp;rdquo;, to do whatever they please, others feel that even though AENA have won the court case they are effectively cutting their nose off to spite their face. &lt;br /&gt;
&lt;br /&gt;
Hence causing one of their principle clients to walk away from Alicante and allocate their &lt;a href="http://www.spanishvilla.com/resources/flight-search" title="search for low cost flights"&gt;Low Cost Flights&lt;/a&gt;&amp;nbsp;to other Spanish airports like &lt;a href="http://www.spanishvilla.com/resources/barcelona-province" title="Information on Barcelona and current weather"&gt;Barcelona&lt;/a&gt;, Bilbao, &lt;a title="Information on Madrid and current weather" href="http://www.spanishvilla.com/resources/madrid-province-info"&gt;Madrid&lt;/a&gt;&amp;nbsp;and &amp;nbsp;Palma de Mallorca. Such measures at the same time have created competition for other airlines principally Air berlin and Iberia Express. &lt;br /&gt;

&lt;h3 class="p1"&gt;&lt;span class="s1"&gt;&lt;strong&gt;Adjust and market your Spanish property for a realistic price&lt;/strong&gt;&lt;/span&gt;&lt;/h3&gt;
&lt;p class="p1"&gt;Forget about what the property cost you and forget about how much of a loss you may be expected to make. Leave your pride and your ego at the door. Those days are gone and realism is the only way forward.&amp;nbsp;&lt;br /&gt;

&lt;p class="p1"&gt;If you have a viewing, get your local agent involved and negotiate his / her commission for finding them the lead. As long as everybody makes something out of the deal in the end it is a job well done. Remember it is a numbers game at the end of the day. Who cares who gets the lead? Just get the house sold.&amp;nbsp;&lt;br /&gt;

&lt;/p&gt;
&lt;h3 class="p1"&gt;&lt;span class="s1"&gt;&lt;strong&gt;Take pride in the appearance&lt;/strong&gt;&lt;/span&gt;&lt;/h3&gt;
&lt;p class="p1"&gt;Whether your property is closed up for many months of the year or if you are currently living in Spain, the way your present your home is very important. Large developers spend money in making sure that their show homes look and smell presentable.&amp;nbsp;&lt;br /&gt;
&lt;br /&gt;
&lt;/p&gt;
&lt;p class="p1"&gt;Do the same you would be surprised how much of a difference it makes. If the property is locked up for months on end, ask someone to do a periodic clean and air the property regularly. There is nothing worse than showing people around a home that smells like an old warehouse.&amp;nbsp;&lt;br /&gt;
&lt;br /&gt;
&lt;/p&gt;
&lt;h3 class="p1"&gt;&lt;span class="s1"&gt;&lt;strong&gt;Viewings&lt;/strong&gt;&lt;/span&gt;&lt;/h3&gt;

Subtly accompany them and if they appear very interested make sure you allow them time to discuss the features of the home amongst themselves. &lt;br /&gt;
&lt;br /&gt;
Don&amp;acute;t let them feel pressurized in any way and do not feed them with too much information all in one go. If they are really interested they will ask you and most likely arrange to view the property again. If it is a Spanish buyer that means with the whole family ;-) Go for it! As many viewings as it takes in order to get that sale.&lt;br /&gt;
&lt;br /&gt;
&lt;/p&gt;
&lt;h3 class="p1"&gt;&lt;span class="s1"&gt;&lt;strong&gt;The Bank&lt;/strong&gt;&lt;/span&gt;&lt;/h3&gt;
&lt;p class="p1"&gt;This is the hardest part of all at the moment. Banks are not willing to be flexible in any way and in many cases have actually stopped lending all together. Your potential buyer needs to have plenty of capital and a good income to even be considered as a potential mortgage candidate.&amp;nbsp;&lt;br /&gt;
&lt;br /&gt;
&lt;/p&gt;
&lt;p class="p1"&gt;Your agency should really determine this quickly to avoid making unnecessary viewings. One thing is to carry out viewings to get a sale and the other is to waste time.&amp;nbsp;&lt;br /&gt;

&lt;/p&gt;

&lt;br /&gt;
&lt;/p&gt;
&lt;p class="p1"&gt;Now that the Partido Popular is in power, it may also mean that the negotiations with the autonomic governments are also made easier and in turn allow for the reduction of ITP tax &lt;em&gt;(Impuesto de bienes inmubles)&lt;/em&gt; applied to Spanish resale properties. Lets stay hopeful.&amp;nbsp;&lt;br /&gt;
